Import Procedures of Plant Origin Food and Feed and Food Contact Materials and Articles

​Im​port operations of plant origin food and feed and food contact materials and articles are carried out within the scope of the following legislation.

​Pest risk analysis results are requested from the exporting country prior to the import of certain plants and plant products determined by the Ministry to be imported into our country. The import of products for which a pest risk analysis has not been conducted is not permitted.

Import Procedures of Plant Origin Food, Feed and Food Contact Materials and Articles - Controls Flow

1- The importer company must first register itself (with petition and signature circular) by applying to the Provincial Directorate to which it is affiliated, and if it is not registered in the system, the manufacturer and exporter company must be registered in the GGBS system.

2- The importer company should make a "pre-notification" at least 3 days before the product arrives at the customs office or before the day the import control is requested. Pre-Notification is made electronically from the section "PRE-NOTIFICATION PROCEDURES FOR IMPORT OF PLANT ORIGIN FOOD AND FEED" on the GGBS system (www.ggbs.tarim.gov.tr).

a- A review fee of 3,748 TL (2023 Price) is charged at the pre-notification stage.

b- The system generates a pre-notification number and password. Since shipment notification will be made with the same notification number and password, this information must be saved.

c- In the pre-notification, information such as content certificate, product name, product class, brand, exporter company name is requested. 

d- The authorized Provincial Directorate will initiate the review on the date the Pre-Notification is sent for approval.

3- The Pre-Notification is reviewed and finalized by the authorized Provincial Directorate within 2 working days. In case of deficiency or additional information-documentation requested by the Provincial Directorate, if the deficiency is completed, the examination is finalized within 2 working days by the Provincial Directorate.

4- If the Pre-Notification is approved, shipment notification can be made by the Importer company. Multiple shipment notifications can be made with one pre-notification.

5- At the stage of shipment information, information about the Health Certificate and the quantity of the product, the Customs Directorate where the product comes from, and the date the control is requested are requested.

6- The date of the control will be determined by the Provincial Directorate within 3 days at the latest from the date the control is requested.

7- An application must be made to the Provincial Directorate with the original documents 1 day before the date of the control request or on the same day.

8- Official Controls are carried out by the Provincial Directorate in 3 stages on the basis of risk.

a- Document Control: It is checked whether the product complies with the Turkish Food Codex on a document basis.

b-ID Control: It is checked whether the product to be imported and the documents submitted to the Ministry are compatible with each other.

c- Physical Control: organoleptic examination, packaging control, sampling and laboratory analysis.

9- As a result of the controls carried out, a letter of conformity is sent to the Customs Directorate via the Single Window System for the entry of products that comply with the Turkish Food Legislation into the country.

10- As a result of the controls, products that do not comply with Turkish Food Legislation are within the knowledge of the owner:

a- Rejected (sent to the country of origin or 3rd country).

b- Subjected to special processing (recheck)

c- Can be used for other purposes.

d- Destroyed.

11- Food and feed imports are currently carried out by 44 Provincial Directorates.

Biosafety

The controls carried out within the scope of biosafety are carried out within the scope of the following legislation.

  • Law No. 5977 on Biosafety
  • Regulation on Genetically Modified Organisms and Products thereof
  • Biosafety Legislation Implementation Instruction 
  • List of Approved GMOs (feed products)

Cannabis Instruction

  1. Cannabis seed to be imported into our country for food or feed purposes should have been subjected to heat treatment in the exporting or producing country "for a minimum of 15 hours at a temperature of 85 ° C" or the germination ability must be removed by "peeling the seeds".
  2. In the event that it is stated in the Phytosanitary Certificate or in the declaration of the competent authority that the germination ability of the product is removed by heat treatment or another internationally accepted method other than peeling, the opinion of the Ministry is requested with detailed information and documents on the subject.
  3. Imported cannabis seed for food or feed purposes is subjected to a 100% analysis frequency to determine whether the germination ability has been removed.
  4. The sample is sent by cargo to the Directorate of Seed Registration and Certification Center (TTSM) to be subjected to germination ability test.
  5. Test costs are deposited to the TTSM revolving fund account by the importer company. (http://www.tarim.gov.tr/BUGEM/TTSM/Menu/24/Ucretler).
  6. As a result of the test, seeds with a germination ability of 5% or less (dead seed percentage of 95% or more) are allowed to enter the country. As a result of the test, seeds with a germination ability of 5% and above (dead seed percentage of 95% and below) are not allowed to enter the country.
  7. As a result of the test, the products whose germination ability is reported to be 5% and above (dead seed percentage is 95% and below) and whose import is not allowed to be imported are written in the relevant section of the Ministry's Information System and the inspection result is closed as negative and the nonconformity letter in the annex of the Communiqué on Product Safety and Inspection of the Ministry of Trade is issued and sent to both the company and the relevant customs directorate.

Irradiation Instruction

  • Food Irradiation Regulation

Arriving in pre packaged or transport packaging with or without the "Radura" mark on the documents of the product subject to shipment: ​

- Spices and Spice Mixtures (sesame seeds, chili peppers, pepper flakes, mint, black cumin, black pepper, red pepper powder, sage, etc. (and their mixtures)),

- Plant (such as chamomile, rose, hibiscus, etc.),

- Herbal Teas, Flavored Herbal Teas, Other Teas (Teas made from single and/or multiple herbs, etc. (including flavored teas)),

- Dried vegetables (dried garlic, dried onions, dried onions, dried tomatoes, etc.),

In the import applications of the products classified above (except organic products), samples are taken to determine compliance with the Irradiation Regulation together with other food safety criteria within the framework of the current "Analysis Frequencies" determined within the scope of the Implementing Instruction on Import Controls of Plant Food and Feed and Food Contact Materials and Articles.

In addition, "Spirulina powder and all spices" originating from "China" are sampled for irradiation analysis at 100% analysis frequency.

In this context, if a document stating that the product subject to shipment is irradiated is submitted, it is necessary to check whether the institution issuing the document is an irradiation facility authorized by the European Union over the country, radiation sources and product groups.

    If it is determined that the institution issuing the document is not authorized, the product should not be allowed to enter the country.

Border Trade

These are the commercial transactions carried out in order to meet some of the needs of the provinces within the scope of the "Decision on the Regulation of Border Trade" annexed to the Presidential Decree dated 2/12/2021 and numbered 2​021/4874, which entered into force by being published in the Official Gazette dated 3/12/2021 and numbered 31678, at a lower cost through imports from border neighboring countries and to provide economic vitality to these provinces by increasing exports from these provinces.

​​​Procedures Regarding the Import of Certain Foodstuffs and Packaging Materials (Plant Origin Food and Food Contact Materials within the Scope of Samples) Free of Charge and Without Commercial Value; 

Relevant Legislation;

Sample quantities that can be processed in this context;

-Food Additives 10 kg or L

-Food Flavorings 1 kg or L

-Raw materials, auxiliary materials and finished goods brought in bulk 50 kg or L

-Packaged Products for Direct Consumption 50 kg or L

-Packaging and Materials in Contact with Food 50 pieces

-Alcoholic Beverages;                    14 pieces in 0.7 liter packaging

                                                      10 pieces in a 1 liter package

                                                        6 pieces in a 1.5 liter package

-Foods for Special Dietary Purposes and Food Supplements;

a) 10 pieces / 4 kg or 4 liters

b) For foods for special nutritional purposes with a package size exceeding 2 kg or 2 liters packaged to be supplied to the end consumer, 10 pieces not exceeding 50 kg or liters at most

c) Substances likely to be used as raw materials (extracts, pastes, extracts, etc.) in foods for special nutritional purposes and food supplements 1 kg or liter,

Product Notification Updates

Applications by the importer should be made to the Provincial Directorate examining the product notification directly or via Registered Electronic Mail (KEP) Address with an official petition, clearly stating the requested issue (the appropriate article of this instruction should be specified.). In addition, in the following cases, the receipt for the "Product Notification Re-examination Fee" deposited to the Provincial Directorate of Agriculture and Forestry Revolving Fund Enterprise account by specifying the product notification number must be attached to the petition.

In this context, in the applications to be made to the Provincial Directorate and / or our General Directorate for various reasons regarding the Preliminary Notification, the following issues should be considered and applications should be made accordingly

A- Notifications of Products Not Submitted for Inspection

1- Choosing the Importer Company Incorrectly

In the event that the importer company is selected incorrectly in product notifications for which payment has been made by entering the product class, product name, brand name and importer company information through the GGBS Preliminary Notification system, but which have not yet been sent to the Provincial Directorate examination; the fee refund requests to be made in writing to the Ministry by those concerned are accepted positively and the Central Revolving Fund Management Directorate of the Department of Support Services is informed to carry out the fee refund transaction.

In case the importer sends the notification for approval and/or the Provincial Directorate reviews the information/documents, the fee cannot be refunded. 

B-Product Notifications at the Inspection Stage;

1- Documents not attached to the product declaration shall be returned by the Provincial Directorate at most twice in case of typographical errors in the declared information and documents and / or if changes are requested by the relevant persons in the declared information and documents.

C- Approved Product Notification:

1- In case the declared GTIP will change,

2- In case of incomplete or incorrect entry of the product name and brand,

3- If the ingredients are not listed in descending order in the ingredient list and/or label,

4- In case of typographical errors in components or other information in the component list,

5- If the declaration regarding the place where the product will be used will change,

6- In case of a correction on the label of the product,

7- In case the country of origin is declared to be incorrectly selected,

8- In case of declaring the wrong manufacturer and / or exporter name and address (in this case, additional documents will be submitted in the annex of the petition) or if the manufacturer company information is requested to be added in notifications where the manufacturer company is not declared,

9- If the importer has more than one record (branches, etc.) and if the application is made through different records (branches, etc.) other than the original importer record,

10- In case the Product Class will change,

For the requests in "Articles 1-9", if the importer makes an official application to the Provincial Directorate of Agriculture and Forestry, which examines the product notification, and the "Product Notification Reexamination Fee" published in the Unit Price List of the Provincial Directorates Revolving Fund Enterprises is paid (attaching the receipt to the petition), the result of the application is notified to the importer by the authorized Provincial Directorate. If the request is positive, the Provincial Directorate Pre-Notification Admin officer will return the pre-notification to the company for review.  

If the request specified in Article "10" is deemed appropriate, the notification is returned to the company for review so that the new product class can be selected. No revolving fund fee is charged for this process. 

For approved Product Notification

11- In the event that the importer is incorrectly selected other than article C-9, 

12- If there is an ingredient in the ingredient list that does not comply with the Turkish Food/Feed Legislation, (In this case, the notification will be inactive.) 

13- In case of errors in the quantities and proportions declared in the component list, 

14- If the ingredient list and the product label are not compatible in terms of content,

15- If you want to remove or add a component from the component list, 

16- In case a TPS document number has been issued, 

no update can be claimed. A refund of the product notification fee for these product notifications cannot be requested. 

D- For rejected Product Notifications

The importer may make a formal application to the Provincial Directorate that examined the preliminary notification with information and documents against the reason for the rejection of the preliminary notification.

By the Provincial Directorate

1- In case it is decided to re-evaluate the preliminary notification, the reason is stated in the explanation field of GGBS and the Provincial Directorate Preliminary Notification is opened for the Provincial Directorate's review by the Provincial Directorate Pre-Notification Administrator.

2- In case the importer's request is evaluated negatively, the reason is notified to the relevant person in writing. Refused product notifications will not be refunded.
